i did the check for updates and i get a little screen that says " check for update was not available at this time " ?????????

Not all users get the update at once, you will get it soon. the updates are always pieced out.

It looks like the message he's getting doesn't exactly refer to no updates being available. When I do a check from my DX, it says "Your phone is up to date. No updates are necessary at this time!"
His message sounds like there's a communication issue between his phone and the update service.
To the OP: Just keep checking back in with it. Try relocating yourself; maybe the signal isn't strong enough or something from where you're checking. If your phone is up to date, you'll see the message I posted above.

That's one of reason why I am starting to dislike droid phones. My DROIDX is fine but if I need to get an updated software. I need to buy a new phone.
