Warranty on used droid x

I bought a "never activated" droid x on ebay. The phones has a clear ESN and is activated on my account. Does the 1 yr warranty still apply? I am getting conflicting answers. Would appreciate an answer.

I've done this in the past and Verizon honored the warranty. If I'm not mistaken after 30 days they will replace with refurb. When asked where I purchased the phone, I told them "third party". They had no issues.

Warranty would be covered by Moto.... What VZW does in the first 30 days is company policy...not warranty.
