xt910 maxx JB update issue

I just got a replacement motorola razr maxx xt910 in place of my old one because it had problems with the vibration of the keys. My old motorola maxx was updated to jelly bean 4.1.2 but this one doesnt seem to be able to update ive tried everything; going to settings about phone and system update. Factory reseted it and tried again. Dialled #*#*checkin#*#* and all that stuff but still keeps saying your device is up to date no update is necessary at this time. I dont want to root my device and flash it and that. Is there any way around thank you in advance

did you try with the MotoCast software in the PC? maybe the OTA update is not available because your new XT910 is refurbish, I read that some refurbished phones don't get OTA updates

Yes i did and that also says my software is up to date
