Don't understand

How can someone with 595 on there phone still get the update. If your on gingerbread how can you get the update for gingerbread. It seems that when the update comes out it would know that your on gb and not give you the update. I just don't get it. Im on 2.2 and waiting. Can someone please explain to me how your still eligible for the update.
