As stupid (and it is) as the lawsuit is, Hasbro (and ASUS for that matter) has plenty of lawyers on retainer. If they don't give the lawyers something to do (but not more than the retainer covers), they lose the money they've paid to keep the lawyers on retainer. I would assume it doesn't take a lawyer too much time to create and file a patent/trademark infringement argument. On the other hand, I further assume that it takes quite a bit more time, energy, and money to defend against said infringement filing.
It's all a form of supposedly "civilized" warfare.
Want to see this kind of idiocy reduced dramatically? Push for tort reform wherein the loser in a civil court case pays the court/lawyer fees of the winner. People and companies would hesitate to sue if they were not very sure of a victory.
