Erm, it's a 50-50. I know for a fact that there are refurbished phones out there (a company called New Breed refurbishes them). I also know that many NEW phones come in the Certified Like New Device box from Verizon (look for a sticker on the back of the phone under the battery that says NB and then a date, if one IS NOT there, it is most likely a new phone).

Just to back up your statement, there are refirbs out now as my current phone is a refirb.

The sticker he is referring to is a small blue circular sticker. Mine happens to say 12/09.
