3 weeks out of warranty? Go to the Motorola website and find the proper support page to punch in the IMEI; it'll tell you if you're out of warranty or if the tech/rep was full of it.
If you're unrooting your device the best method is to flash stock SBF. It doesn't really matter what version, but the latest is here.

If Motorola says the warranty is good then Verizon should honor it provided your phone is unrooted -- rooting voids your warranty, as you well know.
If Verizon refuses to honor the warranty (it's good for 12 months from date of sale) then you can report the behavior at the store and then contact Motorola directly about getting a replacement.
I started another topic about this with my Droid2, and I'm wondering if that's it. I stopped carrying it in the case because it literally looked like I was carrying a gun on me. Hmm. Its sitting on my desk, I let it 'dry' for a few minutes and it seems to be okay now...I had the same thing happen this summer. Turns out it only happened when my phone was in my pocket and subject to some moisture (sweat). Once phone sat on a table for a few minutes, everything is fine. And anytime that I have my Droid in my pocket and I have been hot it does this.

Yeah, there are reasons why we say no antivirus and no task killers.My Droid 1 went totally crazy and unresponsive today. I've had previous issues where the landscape touch screen no longer works when slid all the way up after using a protective case from verizon.
Today, my Droid decided to do what it wanted and extremely slowing and freezing non stop. It is now working again after deleting the antivirus program I put on last week (avg). I would advise anyone having issues to uninstall any recently added apps.
By the way, my phone is all original and not rooted.
