So sorry to get graphic here but the issue is a serious one. I have stressed to my kids, no using phone while driving without headset. We all drive standard so it makes it next to impossible. I have equipped them with headsets to help them comply as they are all younger than 26. They may text and drive but know if I catch them I take their phones (i pay for them, I can take them). I play nasty sometimes and text them when I know they are driving just to see if they text back. Of course they know it's me so I don't get a return text (sometimes I don't when they aren't driving). They also know I can look up cell phone records and know exactly when they text. We have had a few very tragic accidents due to phone use fairly close to home...one that killed 3 teens crossing an intersection and was ran over by a tractor trailer going 55. This is very graphic, so beware. Their car was in tiny pieces and the emt's said their bodies were so mangled they were like hamburger. I remind my kids of these accidents often. Anything I can do to make sure they drive safe is my job. Unfortunately, I can influence them but not the others who carelessly text and drive and place the rest of us in danger.

As a parent, it is your responsibility to teach your children and there is plenty to do to teach your children not to use the phone and drive. If you are paying for their cell phone then it is very easy just by looking up the cell phone details every so often. It all depends on how important their lives are to you.

I'm telling you jntdroid, it is very scary when they get old enough to drive. All the worries you have now are magnified triple fold. Eventually they get more experience and you are not so demanding of being informed of each tiny destination. Enjoy the journey though, nothing compares!

Young than 26? So I assume they are adults. Think it may be time to wean them off the breast milk or cut the umbilical cord?

26, 23, and 20... yup, think that all the time but as a parent, I don't want to wish experience losing any of them and don't want to wish I had done more. As young adults, there is very little I can control but for the two that are still live under my roof and I'm still paying for their education (and their cell phones), I will take advantage of what little safety measures I have available to me. Teaching them to be safe when driving is the least I can do and should be the responsibility of every parent!

BTW, teaching them safety does not start when their 16, 18, or 21 and being a concerned parent does not end at 16, 18 or 21...there is just a whole lot less you can do about it so you better damn well make sure you have taught them long b4 they get there!

Not the Feds!

I agree that holding your cell phone to make calls, send/read a text, and even use as a GPS should be outlawed - but not at the Federal level!! This is a local state matter and they should make the law, not the idiots in DC!! The law should allow use of call phone when it's hands-free, however. That's about as far as it should go. There are already laws for distracted driving that are not enforced (like the idiot reading a newspaper as he drives to work or the bimbo putting her eyelashes on as she cruised down the freeway at 75 this morning).

You can't fix stupid. You can legislate against some of it when it creates a danger for others.
 
It's a good law... it just does not fall within the Federal Government's Constitutional mandate. So... state law it is, then. Besides, we already have Careless/Reckless/Dangerous driving laws on the books; why not simply use them?
