Yes VZW took something and split it to make more money. Their right as a on going business concern.
Ehh, you're right that it's tangible. They did it and thus it's unauthorized to circumvent it. But I believe the bold portion is dubious and debatable. If something like this were ever taken to a court of law, I have my doubts as to whether it would hold up or not.
lol @ "Things are moving faster than I thought."
Really? I love a good laugh, whats so funny about that?
This is a classic "string them along" tactic. Mind you, I'm not saying that he is making anything up at all. I'm saying that the time for vague and dramatic hints has come and gone. It reminds me of soap operas or shows like Lost, that use cliff-hangers and mysterious, undefined plot devices to keep audiences on the edge of their seats for the payoff revelation, but then only deliver another mysterious, undefined cliff-hanger to spur the show along.
Yeah, that works for a while, but eventually people get tired of constantly being teased with information and just want to get on with it already. They realize that the show is no longer a real "drama" and is instead just a laughable attempt to cover up lack of any true substance.
At this point, if he isn't going to say specifically what is going on, it's only real value is for comic relief, IMO. It stopped being good drama a few tweets ago. Again, I will eat all crow available to me if/when the day comes I'm wrong.
the ToS specifically states that any changes to the phone's software takes it out of specification for use on their network
If you're referring to part "e" of their "End Service" section, that is customarily interpreted as meaning hardware specifications. "Software" is never explicitly mentioned. Additionally, it is somewhat illogical to assume it refers to software as that changes constantly. As soon as you were pushed an OTA Gingerbread or Froyo update from the carrier, they would then be able to cut off your service, according to that interpretation.
I thought the Supreme Court's ruling last year made rooting/jailbreaking legal, and basically said that, while it can still void the warranty, the service cannot be terminated b/c of it?
That was the Library of Congress. And their jurisdiction there is questionable. Oh, and Squire is
more correct on the warranty/ToS issue than those opposing him. You are not violating ToS by rooting. You may void your warranty, but that is not the same as them denying you service.
When I asked about all of this he started cracking up saying he read this too and thinks it's hilarious. It is actually a running joke right now in Corp VZW.
I completely agree with him. Not just because I said the same things all day yesterday, but because it should be a running joke.
My cousins quote regarding rooting was quite simple...."root your phone....void your warranty....we don't care because we have tons of phones....we can just sell you another one."
Bingo. Like I said, it's a warranty issue, NOT a ToS issue. Too bad people won't listen to this. And don't give out your cousin's number as that could still get him in trouble and this internet dramatization isn't worth that. Let people believe otherwise if they want to.
Sorry for the long post.
